Terms & Conditions

Welcome to the Airway School website. By accessing and using this website, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before using the site.

In general, our Terms & Conditions cover the following:

1. Educational Content and Advice


The educational content is provided solely for reference purposes and does not necessarily stand on its own. It is not intended to be, nor should it be, relied upon for selecting or providing specific treatment to a patient, nor should it substitute professional judgment in any given situation. Any advice provided by us, or by any of our presenters, during a course day, networking event, presentation, or any other event hosted by Airway School, is generic in nature and does not take into account individual medical or other conditions that may affect a patient or the treatment they receive.

2. Limitation of Liability


To the fullest extent permitted by law, neither we nor any presenters at any of our events (including course days, networking events, presentations, or other events hosted by Airway School) will be liable to you for any loss, injury, claim, liability, or damage of any kind (whether direct or indirect) resulting in any way from:
- (a) your use or misuse of the educational content; or
- (b) any advice or content provided during any event; or
- (c) any errors in or omissions from the educational content; or
- (d) any cancellation or postponement of a course day, networking event, or presentation.

We shall not be liable for any losses or damages incurred by you, whether they arise in contract, tort (including negligence), or otherwise, and fall within the following categories:
- (a) losses or costs associated with cancelled or rearranged travel arrangements;
- (b) loss of profits;
- (c) loss of anticipated savings;
- (d) loss of business opportunity;
- (e) loss of goodwill;
- (f) loss of data;
- (g) claims made against you by patients or third parties; or
- (h) any special, indirect, consequential, or pure economic loss, costs, damages, charges, or expenses.

Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution, or otherwise arising in connection with the training course shall be limited to the event registration fees actually paid by you.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

3. Insurance Responsibility


It is your sole responsibility to secure appropriate professional indemnity insurance, which covers you for live patient courses or events.

4. Termination


We may terminate the contract between you and us by written notice for any of the following reasons:
- (a) if you fail to conduct yourself in an appropriate manner when communicating with or receiving support from us. This includes threatening, intimidating, or harassing our staff or others, or behaving violently or in a manner that threatens the physical safety of anyone present at a course day or event;
- (b) if you continue to disrupt the learning environment during an event, having been previously asked to desist;
- (c) if you fail to comply with any of your obligations under these Terms and do not remedy the breach within seven (7) days of a request from us;
- (d) if you fail to pay the event registration fees or any other sums due.

If we terminate the contract, your right to attend any course day or event and to access educational content will immediately cease, and all unpaid event registration fees will become immediately due and refunds will not be issued.

5. Force Majeure


We will not be liable or responsible for any failure or delay in performing any obligations under these Terms if caused by events beyond our reasonable control (‘Force Majeure Event’). A Force Majeure Event includes, but is not limited to:
- Strikes, lock-outs, or other industrial action;
- Civil commotion, riots, terrorist attacks, war, or the threat or preparation for war;
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other extreme weather conditions or natural disasters;
- Transportation disruptions (public or private);
- Telecommunications disruptions (public or private); or
- The death, incapacity, or illness of any presenter or faculty member involved in delivering a course day, event, or presentation.

If a course day or event is affected by a Force Majeure Event, we will use reasonable efforts to reschedule. If additional costs arise from rescheduling, we reserve the right to increase the event fees accordingly.

6. Assignment


You may not transfer your rights or obligations under these Terms to another person without our prior written consent. We may assign or transfer all or any of our rights and obligations to another suitable organisation, which will not affect your rights under these Terms.

7. Notices


All notices must be sent to Airway School at the email address provided, or as specified in the order form. We may send notices to you at the email, phone number, or postal address you provided when registering for the event. Notices sent by email or SMS will be deemed received 24 hours after sending, and letters will be deemed received three days after posting.

8. General


If any of these Terms are deemed invalid or unenforceable by any competent authority, they shall be severed from the remaining Terms, which will continue to be valid to the fullest extent permitted by law.

We reserve the right to revise and amend these Terms from time to time, with any changes posted to our website.

Our failure to insist on the performance of any obligation, or failure to exercise any right or remedy under these Terms, will not constitute a waiver of those rights or remedies. Any waiver must be made in writing.

These Terms shall be governed by the laws of England and Wales. Any disputes, including non-contractual disputes and claims, shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

9. Intellectual Property and Use of Educational Content

​

Airway School and its Faculty are the owners or licensees of the copyright, trademarks, and all other intellectual property rights in the content of the presentations, support literature, and any other materials or documents provided in connection with the events (referred to as ‘Educational Content’). We expressly reserve all rights in the same.

​

In consideration of the event registration fees paid by you, we grant you a non-exclusive, non-transferable licence to use the Educational Content solely for your personal research, study, or professional training and development. This licence is specific to you and cannot be transferred to another person or entity.

If any software is required for participation in an Airway School event, it is your responsibility to ensure you have the appropriate licences for its use and to comply with the terms of those licences.

10. Restrictions on Use

​

The Educational Content is provided for individual learning purposes and is subject to restrictions on copying, sharing, and distribution. Unless expressly authorised in writing by Airway School, any copying, reproduction, or other use of the Educational Content, beyond your personal research, study, or professional development, is strictly prohibited.

​

Specifically, you are not permitted to:

  • Share the Educational Content with any third party.

  • Present any portion of the Educational Content as your own. Should you wish to discuss our content with others, you must gain permission and reference the treating clinician.

  • Use the Educational Content for public presentations or promotional purposes without prior written consent from Airway School.

 

11. Webinars and Access to Online Content

​

Access to Airway School's webinars and other online content is available for the duration of the event or course once the registration fee has been paid and all payments are up to date according to the agreed payment plan. If payment plans lapse, we hold the rights to remove your access.

12. Compliance with UK Law

​

Airway School operates in compliance with UK law, including but not limited to the Copyright, Designs and Patents Act 1988 and other applicable intellectual property and data protection laws. Any unauthorised use of the Educational Content may result in legal action.

13. Intellectual Property Rights

​

We reserve the right to take any legal action necessary to protect our intellectual property, including but not limited to seeking damages for unauthorised use, reproduction, or distribution of the Educational Content.

14. Responsibility for Loss or Damage

​

You are responsible for any loss or damage caused by you to any equipment or property belonging to Airway School or the venues we use, except for damage caused by fair wear and tear. In such cases, you will bear the full cost of repair or replacement of the damaged property.

​

In accordance with UK law, Airway School reserves the right to hold the entire delegate group liable for any malicious damage caused by one or more members of the group if the individual(s) responsible do not admit their responsibility. This may include collective financial responsibility for repair or replacement of damaged property, in line with joint and several liability principles where applicable.

15. Cancellations and Refunds

​

Cancellations of bookings or registrations for events, course days, networking events, presentations, or any other events hosted by Airway School are at our sole discretion.

​

If you wish to cancel your booking, you must notify us in writing. Airway School reserves the right to either issue a refund or withhold any event registration fees paid, depending on the timing of the cancellation and other circumstances, which will be assessed on a case-by-case basis. We are under no obligation to refund any event registration fees, except where required by applicable law.

​

For cancellations made by Airway School due to unforeseen circumstances, including but not limited to Force Majeure events (as defined in these terms), we will use reasonable efforts to reschedule the event or offer an alternative date. If rescheduling is not possible, we may offer a refund or credit toward a future event, subject to our discretion.

​

Nothing in this clause affects your statutory rights under UK consumer law, including the Consumer Rights Act 2015, where applicable.

​

This clause complies with UK law.
